What is the EB-5 Program?
The EB-5 Immigrant Investor Program is a government initiative designed to attract foreign capital into job-creating projects across the United States. Established by Congress in 1990 as a tool for economic growth, the program offers qualifying investors and their families the opportunity to obtain lawful permanent resident status — commonly known as a green card — in exchange for a qualifying investment in an approved U.S. project.
A single EB-5 petition covers the investing individual along with their immediate family — including their spouse and any unmarried children under 21 years of age — each of whom becomes eligible to pursue permanent resident status through the same application.

Steps
How is the EB-5 process?

I-526 Petition filed by your attorney
A
Your immigration attorney drafts the I-526 Immigration Petition and conducts a thorough review of the legal source of your investment funds.
B
An administrative fee of US$70,000 is paid, along with the US$1,050,000 investment into the qualifying EB-5 project.
C
The applicable USCIS filing fees for the I-526 petition are submitted.

Processing through the relevant U.S. Consulate
Consular interview and review
Inside the United States
Proceed with adjustment of status application, which includes authorization to work and permission to travel internationally

Upon approval of the I-526 petition by USCIS, conditional permanent resident status is granted.

A Conditional Permanent Resident Green Card is issued.

Within two years of receiving conditional permanent residency, file Form I-829 to remove conditions and obtain unconditional permanent resident status.

Upon project completion and job creation verification, at-risk investment capital becomes eligible for return.
